Thank you for your business and we hope you enjoy your stay in our property!

RENTER REQUIREMENTS
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees. 

DOWN PAYMENT AND FINAL PAYMENT
50% of the reservation total is due at time of booking. Final payment will be required 30 days prior to checking-in to your vacation rental.

ARRIVAL AND DEPARTURE TIME
Check out is at {reservations.property_check_out_time}. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged a fee for each hour beyond 11 am you are still on property, at a minimum of one hour. If the cabin has not been vacated by {reservations.unit_check_in_time}, a fee equal to the rental rate of one day may be assessed.

UNPAID RENT AND DAMAGE POLICY 
As a condition to the rental of all vacation properties, Eastman Premier Rentals and Sales reserves the right to charge the guest's credit card for any and all unpaid rental amount, uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Eastman Premier Rentals and Sales is hereby granted the right to charge the guest's credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.

CANCELLATIONS 
Power/ weather related cancellation: Eastman Premier Rentals and Sales does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires.

Upon cancellation of this lease up to one month prior to the lease term, lessee shall be charged a fee of Five Hundred AND 00/100 DOLLARS ($500.00) to the credit card provided in Section II of the lease agreement. Cancellation within one month of the lease term shall result in a charge of the full lease amount. For Longer term rentals (one month or more):  Tenants are responsible for the terms of the lease.

QUIET ENJOYMENT  
Lessor covenants that on paying the rent and performing the covenants contained in this Lease, Lessee shall peacefully and quietly have, hold, and enjoy the Leased Premises for the agreed term.

USE OF LEASED PREMISES
A. The Leased Premises shall be used and occupied by Lessee exclusively as a private single-family residence. The Leased Premises shall not be used at any time during the term of this Lease for any business, profession, or trade of any kind, or for any purpose other than as a private single-family residence.

B. Lessee shall comply with all laws, ordinances, rules and orders of governmental authorities, restrictive covenants and rules of any community or homeowner's association affecting the Leased Premises, during the term of this Lease.

C. Lessee shall not conduct himself/herself in a manner, nor permit Lessee's family, employees, agents or visitors to conduct themselves in a manner, that would adversely affect other individuals or neighbors in proximity to the Leased Premises.

D. No Smoking Policy. Tenant, or Tenant’s family or guests shall not smoke within premises. This includes smoking cigarettes, cigars, pipes or any other smoking device.

NUMBER OF GUESTS 
Change in number of guests/conduct of guests: guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the vacation rental at any time could result in extra charges for each additional guest, in addition to any and all damage, disturbance, and cleaning charges. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis - please contact Eastman Premier Rentals and Sales for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.

RIGHT OF ENTRY    
Guest(s) agree that Eastman Premier Rentals and Sales reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate.

SECURITY AND SAFETY RISKS 
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. Eastman Premier Rentals and Sales does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in buckets outside, or supplied emergency candles in case of power outage.

UPON ARRIVAL 
Lessee is responsible for completing the property condition report and returning it to the Lessors Agent’s office, Eastman Premier Rentals within 24 hours of arrival. Lessee is responsible for leaving the property neat and clean upon departure. If upon inspection after checkout, the rental unit has been left excessively dirty or untidy or at the Lessee request at check in EPR can arrange to have the rental unit cleaned for $35.00 per hour. On departure Lessee who do not return the Property Condition Report signed within the time frame EPR must charge for all cleaning and damages found in the rental unit on departure.

EMERGENCIES AND MAINTENANCE 
In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the sEastman Premier Rentals and Sales office (leave a voice message if there is no answer!) at . If it is after office hours we will make every effort to return your call as soon as possible.

PLUMBING AND HEATING
Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain. 
If you are leaving the premises for more than 24 hours set the heat to no lower than 50 degrees in the colder winter months. 

ASSIGNMENT AND SUBLETTING 
A. Without the prior, express and written consent of Lessor, Lessee shall not assign this Lease, sublet, or grant any concession or license to use the Leased Premises or any part of the Leased Premises.

B. Consent by Lessor to one assignment, sublet, concession or license shall not be deemed to be a consent to any subsequent assignment, sublet, concession or license.

C. An assignment, sublet, concession or license without the prior written consent of Lessor, or an assignment or sublet by operation of law shall be void and shall, at Lessor’s option, result in a violation of this Lease.

ALTERATIONS AND IMPROVEMENTS
Lessee shall make no alterations or improvements to the buildings on the Leased Premises

DANGEROUS MATERIALS
Lessee shall not keep or bring upon the Leased Premises any article or thing of dangerous, inflammable or explosive character that might unreasonably increase the danger of fire on the Leased Premises or that might be considered hazardous or extra hazardous by any responsible insurance company and by which the insurance on said Leased Premises may be affected.

UTILITIES
Utility costs, as may be applicable, for electric, propane, telephone (excepting long distance phone calls, if any), cable TV, internet service, water/sewer and trash removal services are included in the total rental amount during the term of this lease. Cable TV and/or internet service upgrades (in addition to provided services) shall be at the sole expense of the TENANT. The security deposit or any part thereof, paid under paragraph 7 shall not be refunded to the TENANT until the Rental Agent has provided written authority to do so subject to all terms and conditions of this lease.

ANIMALS
Lessee shall not keep any domestic or other animals on or about the Leased Premises without the prior, express and written consent of Lessor.

GOVERNING LAW 
It is agreed that this Lease shall be governed by, construed and enforced in accordance with the laws of the State of New Hampshire.

ATTORNEY FEES 
In the event that any action is filed in relation to this Lease, the unsuccessful party in the action shall pay to the successful party, in addition to all the sums that either may be called upon to pay, a reasonable sum for the successful party’s attorney fees and costs.

JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.

ENTIRE CONTRACT: Time is of the essence. All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties` agreement, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforce ability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach. 

RELEASE: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my childrens or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
